HOSTEROOO BOOKING T&C

Important Notice: 
These Booking Terms and Conditions apply exclusively to direct bookings made through the Hosterooo platform, website, or booking engine. They do not apply to bookings made through third-party channels such as Airbnb, Booking.com, VRBO, or other external platforms. Bookings through those channels are subject to their own respective terms and conditions. 


1. Booking Process 

1.1. Property Selection: Users may browse available properties and select one to rent based on preferences.

 
1.2. Booking Application: Bookings are submitted through our booking engine by selecting available dates and completing the booking form. 


1.3. Booking Confirmation: Bookings may be confirmed automatically (Instant Booking) or require approval by the property owner. A booking is only confirmed when a confirmation notification is sent to the renter. Availability is not guaranteed until confirmation is received. 


1.4. Payments: Payment terms, including any deposits or prepayments, will be provided during the booking process. 


1.5.  No Guarantee of Availability: Availability displayed on the platform is subject to change until a booking is confirmed. The platform is not responsible for bookings not completed due to changes in availability. 


2. Cancellations and Changes 

2.1. Cancellation by Renter: Cancellations must comply with the property owner’s cancellation policy, which may involve fees or forfeiture depending on timing. 
 
2.2. Cancellation by Property Owner: If the property owner cancels a confirmed booking, any payments made will be refunded in full. The platform’s responsibility is limited to refunding payments processed through it and does not cover indirect costs such as travel expenses. 
 
2.3. Booking Amendments: Changes to confirmed bookings (e.g., dates or number of guests) require approval by the property owner and may incur additional charges.


2.4. Failure to Provide Legally Required Guest Information:
In accordance with national or local laws, including Spanish regulations requiring guest registration with the authorities, all guests (including children) must provide complete and accurate personal information before check-in. Required information includes, but is not limited to: full name, date of birth, passport or ID number, home address, phone number, and email address. 
 
If any guest fails to provide the required information by the deadline specified in the booking confirmation, and as a result the booking cannot legally proceed or the property owner may incur fines or penalties, the property owner reserves the right to cancel the booking without a refund. It is the renter’s responsibility to ensure all guests supply this information in a timely and accurate manner. 


3. Check-in and Check-out 

3.1. Check-in: Details, including time and process, will be provided by the property owner. Renters should confirm these in advance. 
 
3.2. Check-out: Renters must vacate the property by the specified check-out time. Failure to comply may result in extra charges. 
 
3.3. Late Check-out: Requests for late check-out are subject to the property owner’s approval and may incur additional fees. 


4. Renter Responsibilities 

4.1. Care of the Property: Renters must take care of the property. Damages must be reported immediately. Renters may be liable for repair or replacement costs. 
 
4.2. Occupancy Limits: Renters must not exceed the maximum occupancy limit stated in the property listing. Violations may result in cancellation without refund. 
 
4.3. Noise and Behaviour: Renters are expected to respect neighbours and comply with local noise regulations. Disruptive behaviour may lead to eviction without refund. 

5. Security Deposits 

5.1. Deposit Requirements: A security deposit may be required. The amount and terms will be communicated during booking. 
 
5.2. Deposit Refunds: Deposits are typically refunded within a specified period after check-out if there are no damages or violations. 


6. Liability and Disclaimers 

6.1. Platform Role: Hosterooo acts solely as an intermediary between property owners and renters. It does not own, control, or manage properties and is not a party to the rental agreement. 
 
6.2. Insurance: Renters are encouraged to obtain insurance to cover unforeseen circumstances, including cancellations, injuries, or property damage. 


7. Dispute Resolution 

7.1. Disputes Between Parties: Disputes between renters and property owners must be resolved directly. Hosterooo does not mediate or resolve such disputes. 
 
7.2. Platform Assistance: Hosterooo may, at its discretion, assist with communication but has no obligation to do so. 


8. No Tenancy Created 

8.1. This agreement is for temporary accommodation only. It does not create a tenancy or give the guest rights of exclusive possession beyond the confirmed booking period. 


9. Jurisdiction and Governing Law 

9.1. These Terms are governed by the laws applicable to the location of the property rented. Legal proceedings shall be brought in the courts of that location, without prejudice to your rights under local consumer protection laws. 


10. Amendments to Booking Terms 

10.1.  Hosterooo reserves the right to modify these Terms at any time. Changes take effect upon posting. Continued use of the platform constitutes acceptance of updated Terms.
